The short version
Silent Night reads your restaurant's numbers overnight and sends you a short brief by email and, if you ask for it, by text. It only reads; it never changes anything in your systems. Your data stays yours. You can stop at any time, and we will delete your data when you ask.
01Who we are
Silent Night is operated by Hospitality Uncut ("Silent Night", "we", "us"). These terms cover silentnight.app, the Silent Night service, and the emails and text messages it sends. By using the service, or by connecting your systems to it, you agree to these terms on behalf of your business.
02The service
Silent Night connects to the systems your venue already uses (such as your point of sale and timeclock), compares each night with what is normal for your venue, and sends a morning brief, weekly and monthly recaps, and alerts when something needs attention. Members of our team review results and may contact you about them.
Silent Night is currently offered by invitation during a private testing season. Features may change as we improve the service, and we will tell you before removing anything you rely on.
03Connecting your systems
- Read-only access. We ask for read access only. Silent Night never creates, edits, refunds or voids anything in your point of sale or timeclock.
- Your authority. You confirm that you are allowed to connect the accounts you connect, and that you have any permissions needed from your business partners.
- Disconnecting. You can revoke our access at any time from your point of sale's settings, or by asking us to do it for you.
04Your data
You own your data. You give us permission to collect, store and analyze it only to provide Silent Night to you. We do not sell it, share it with other clients, or use it for anything outside your service. Our privacy page explains exactly what we collect, how it is stored and who can see it.
05Text messages
If you choose to receive Silent Night by text, these terms apply to our text program, Silent Night Alerts.
- What you get. Your morning recap and alerts about your own venue's business, such as an unusual night, a labor or discount spike, or an upcoming license renewal.
- How often. Usually one to three messages a day. It varies with how much needs your attention.
- Consent. We only text numbers that have opted in, during onboarding or by asking our team. Agreeing to receive texts is not a condition of using Silent Night.
- Cost. Message and data rates may apply, depending on your mobile plan.
- Stopping. Reply STOP at any time to stop all texts. You will get one message confirming that you have been removed. Reply START to opt back in.
- Help. Reply HELP for help, or email reports@silentnight.app.
- Delivery. Mobile carriers are not liable for delayed or undelivered messages.
Phone numbers collected for texting are used only to send you these messages. They are never sold or shared with third parties or affiliates for marketing or promotional purposes.
06Information, not professional advice
Silent Night's reports and suggestions are information to help you run your business. They are not accounting, tax, legal or financial advice, and decisions about your business remain yours. Our numbers come from your own systems, so if something looks off, check it against your point of sale's reports and tell us.
07Accuracy and availability
We work hard to keep Silent Night accurate and on time, but it depends on the systems it reads from and on outside providers. Reports can be late, incomplete or wrong if a source system is down or reports data late. We do not guarantee that the service will be uninterrupted or error-free, especially during the testing season.
08Fees
Any fees, and what they cover, are agreed with you in writing before you are charged. During the testing season, any trial or founding terms we offer you will be confirmed in writing.
09Using Silent Night fairly
Please don't share your reports' private links or access with people outside your business, attempt to access another client's data, interfere with the service, or copy or resell it.
10Other services
Silent Night works with services run by other companies, such as your point of sale (for example Square, Toast or Clover), Google, and the providers that deliver our email and text messages. Your use of those services is covered by their own terms.
11Ending the service
You can stop using Silent Night at any time by telling us. We may end or pause the service if these terms are broken or if we stop offering it, and we will give you notice where we can. When the service ends, we will delete your data on request and confirm when it is done.
12Limits of liability
To the extent the law allows, Silent Night is provided "as is", and we are not liable for indirect or consequential losses, such as lost profits, that come from using or relying on the service. Our total liability for any claim is limited to the fees you paid us in the three months before the claim.
13Changes to these terms
If we change these terms, we will update the date at the top of this page and tell active clients about any significant change before it takes effect.
14Governing law and disputes
These terms are governed by the laws of the Commonwealth of Virginia. Any dispute about these terms or the service will be heard in the state courts located in the City of Richmond, Virginia, or in the United States District Court for the Eastern District of Virginia, Richmond Division, and both sides agree to those courts.
Questions about these terms? Ask the people who run it. Email reports@silentnight.app.
